Serwis internetowy działający pod adresem www.lostphotoframes.com (zwany dalej „Serwisem”) jest prowadzony przez: Annę Pupczyk prowadzącą działalność gospodarczą pod firmą Anna Pupczyk Fotografia, z siedzibą przy ul. Cystersów 12/28, 31-553 Kraków, NIP: PL7382066006 (zwaną dalej „Sprzedawcą”).

The online service operating at www.lostphotoframes.com (hereinafter referred to as the "Service") is managed by: Anna Pupczyk conducting business under the name Anna Pupczyk Fotografia, with its registered office at ul. Cystersów 12/28, 31-553 Kraków, NIP: PL7382066006 (hereinafter referred to as the "Seller").

Regulamin określa zasady korzystania z Serwisu, składania zamówień na produkty dostępne w Serwisie, dostarczania zamówionych produktów Klientowi, uiszczania przez Klienta ceny sprzedaży produktów, uprawnienia Klienta do rezygnacji z zamówienia i odstąpienia od umowy oraz zasady składania i rozpatrywania reklamacji.

These Terms and Conditions define the rules for using the Service, placing orders for products available in the Service, delivering the ordered products to the Customer, payment of the sale price by the Customer, the Customer's right to cancel an order and withdraw from the contract, as well as the rules for submitting and processing complaints.

Sprzedawca prowadzi sprzedaż detaliczną produktów za pośrednictwem sieci Internet, prezentując autorskie fotografie w formie oprawionych obrazów, wydruków artystycznych oraz innych artykułów dekoracyjnych i wydawniczych.

The Seller conducts retail sales of products via the Internet, presenting original photography in the form of framed pictures, fine art prints, and other decorative and publishing items.

Kontakt ze Sprzedawcą odbywa się za pośrednictwem poczty elektronicznej pod adresem: info@lostphotoframes.com lub pisemnie na adres siedziby wskazany w ust. 1.

Dzień Roboczy – jeden dzień od poniedziałku do piątku z wyłączeniem dni ustawowo wolnych od pracy.

Business Day – one day from Monday to Friday, excluding public holidays in Poland.

2.

Klient – osoba fizyczna, osoba prawna lub jednostka organizacyjna nieposiadająca osobowości prawnej, dokonująca zakupu w Serwisie.

2.

Customer – a natural person, a legal person or an organizational unit which is not a legal person, to which special provisions grant legal capacity, who places an Order within the Service.

3.

Konsument – osoba fizyczna dokonująca zakupu w celu niezwiązanym bezpośrednio z jej działalnością gospodarczą lub zawodową.

Consumer – a natural person performing a legal transaction with the Seller not directly related to their business or professional activity.

4.

Produkt – rzecz ruchoma lub treść cyfrowa dostępna w Serwisie, będąca przedmiotem Umowy Sprzedaży. Wszystkie Produkty fizyczne oferowane w Serwisie są tworzone na indywidualne zamówienie Klienta (model Print-on-Demand) według wybranej przez niego specyfikacji (w szczególności wybór formatu, ramy, obecność i kolor passe-partout).

Product – a movable item or digital content available in the Service, being the subject of the Sales Agreement. All physical Products offered in the Service are created to the Customer's individual order (Print-on-Demand model) according to the specifications selected by them (in particular, the choice of format, frame, presence and color of the passe-partout).

5.

Dzieło – autorska fotografia stanowiąca integralną część Produktu, do której autorskie prawa majątkowe należą do Sprzedawcy.

Artwork – an original photograph constituting an integral part of the Product, the economic copyrights to which belong to the Seller.

6.

Potwierdzenie autentyczności - każdy produkt fizyczny jest trwale sygnowany na rewersie oznaczeniem marki LostPhotoFrames (np. w formie naklejki z logotypem, sygnetem, kodem QR). Integralną częścią Produktu jest Cyfrowy Certyfikat Autentyczności, dostarczany Klientowi drogą elektroniczną po sfinalizowaniu zamówienia. Certyfikat zawiera dane o Dziele, potwierdzenie praw autorskich oraz gwarancję legalności wizerunku obiektów (§ 9 ust. 8), o ile taka jest wymagana. W przypadku edycji limitowanych, Certyfikat zawiera również unikalny numer egzemplarza oraz określenie całkowitego nakładu danej serii.

Proof of Authenticity – each physical product is permanently signed on the reverse with the LostPhotoFrames brand mark (e.g., in the form of a sticker with a logo, signet, or QR code). An integral part of the Product is the Digital Certificate of Authenticity, delivered to the Customer electronically after the order is finalized. The certificate contains data about the Artwork, confirmation of copyrights, and a guarantee of the legality of the image of objects (§ 9 sec. 8), if required. In the case of limited editions, the Certificate also includes a unique copy number and the specification of the total edition size for a given series.

7.

Umowa Sprzedaży – umowa sprzedaży Produktu zawarta między Sprzedawcą a Klientem za pośrednictwem Serwisu.

Sales Agreement – a sales contract for the Product concluded between the Seller and the Customer through the Website.

8.

Zamówienie – oświadczenie woli Klienta zmierzające bezpośrednio do zawarcia Umowy Sprzedaży, określające w szczególności rodzaj i liczbę Produktów.

Order – the Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Products.

9.

Postanowienia niniejszego Regulaminu dotyczące Konsumenta stosuje się również do osoby fizycznej zawierającej Umowę Sprzedaży bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego.

The provisions of these Terms and Conditions regarding the Consumer shall also apply to a natural person concluding a Sales Agreement directly related to their business activity, when the content of this agreement shows that it is not of a professional nature for this person.

Zakres usług - Sprzedawca świadczy drogą elektroniczną bezpłatne usługi umożliwiające przeglądanie zawartości Serwisu, korzystanie z koszyka, formularza kontaktowego oraz prowadzenie Konta.

Scope of services – The Seller provides free electronic services enabling browsing of Website content, using the shopping cart, contact form, and maintaining an Account.

Konto (Obowiązkowe) - realizacja zakupów w Serwisie wymaga założenia Konta. Umowa o świadczenie usługi Konta zostaje zawarta na czas nieoznaczony w momencie potwierdzenia rejestracji. Konto umożliwia:

korzystanie z funkcji interaktywnych, takich jak komentowanie wpisów na blogu lub dodawanie opinii.

use of interactive features, such as commenting on blog posts or adding reviews.

Rejestracja - proces rejestracji następuje podczas składania pierwszego zamówienia lub poprzez dedykowany moduł rejestracji.

Registration - the registration process occurs during the first order or via a dedicated registration module.

4.

Usuwanie konta - Klient może usunąć Konto w dowolnym momencie bez podania przyczyny. Usuwanie Konta skutkuje utratą dostępu do historii zamówień oraz plików cyfrowych wewnątrz Serwisu; zaleca się niezwłoczne pobranie Produktów Cyfrowych na własny nośnik po zakupie.

Deleting the account - the Client may delete the Account at any time without giving a reason. Deleting the Account results in the loss of access to order history and digital files within the Website; it is recommended to download Digital Products to your own carrier immediately after purchase.

Zasady publikowania treści i moderacja:

Użytkownik posiadający Konto zobowiązany jest do powstrzymania się od publikowania treści o charakterze bezprawnym, reklamowym lub naruszającym dobre imię marki LostPhotoFrames.

A User with an Account is obliged to refrain from publishing unlawful or advertising content, or content that violates the reputation of the LostPhotoFrames brand.

b.

Sprzedawca zastrzega sobie prawo do moderacji lub usuwania treści naruszających powyższe zasady.

b.

The Seller reserves the right to moderate or delete content that violates the above rules.

c.

Opinie o Produktach: ze względu na dbałość o rzetelność, publikowanie opinii o Produktach jest dostępne wyłącznie dla Klientów, którzy dokonali zakupu danego Produktu (opinie zweryfikowane).

c.

Product Reviews: to ensure reliability, posting Product reviews is available only to Clients who have purchased a given Product (verified reviews).

6.

Wymagania techniczne: do korzystania z Serwisu niezbędne jest urządzenie z dostępem do Internetu, aktualna przeglądarka oraz aktywny adres e‑mail.

Technical requirements: to use the Website, a device with Internet access, an up-to-date web browser, and an active e‑mail address are required.

7.

Dane kontaktowe: ze względu na proces dostawy, Klient zobowiązany jest do podania aktywnego numeru telefonu komórkowego w polskiej sieci komórkowej. Sprzedawca nie ponosi odpowiedzialności za błędy wynikające z podania nieprawidłowego numeru.

Contact data: due to the delivery process, the Client is required to provide an active mobile phone number within a Polish mobile network. The Seller is not responsible for errors resulting from providing an incorrect number.

Klient składa zamówienie poprzez interaktywny formularz w Serwisie, dokonując wyboru Produktu oraz jego specyfikacji (np. kadru, formatu, rodzaju oprawy lub nośnika).

The Client places an order via an interactive form on the Website, selecting the Product and its specifications (e.g., frame, size, type of framing or medium).

b.

Przesłanie zamówienia przez Klienta stanowi ofertę zakupu. Umowa zostaje zawarta w momencie otrzymania przez Klienta wiadomości e‑mail potwierdzającej przyjęcie zamówienia do realizacji przez Sprzedawcę.

b.

Submission of the order by the Client constitutes an offer to purchase. The contract is concluded upon the Client's receipt of an e‑mail confirming the acceptance of the order for processing by the Seller.

Sprzedawca prowadzi Serwis w modelu Print-on-Demand (produkcja na zamówienie), co oznacza, że proces wytworzenia Produktu fizycznego rozpoczyna się po zaksięgowaniu płatności.

The Seller operates the Service in a Print-on-Demand model (made-to-order), which means that the production process of a physical Product begins after the payment has been credited.

b.

Z uwagi na rzemieślniczy charakter produkcji oraz dbałość o najwyższą jakość (m.in. procesy schnięcia, kontrola barwna, precyzyjna oprawa), prace produkcyjne i logistyczne realizowane są w dedykowanych blokach czasowych, co pozwala na zachowanie butikowego standardu obsługi. Wszystkie terminy podawane są w Dniach Roboczych.

b.

Due to the artisanal nature of production and attention to the highest quality (including drying processes, color control, precision framing), production and logistics work are carried out in dedicated time blocks, which allows for maintaining a boutique standard of service. All deadlines are provided in Business Days.

Czas realizacji zamówienia jest uzależniony od kategorii Produktu oraz stopnia złożoności prac rzemieślniczych, a jego wiążący termin każdorazowo określa specyfikacja widoczna na stronie danego Produktu w sekcji „DROGA DO CIEBIE”.

The order fulfillment time depends on the Product category and the complexity of the craftsmanship; the binding lead time is specified in each case on the Product page under the "THE WAY TO YOU" section.

W przypadku Produktów fizycznych (m.in. wydruki, ramy, płótna) czas przygotowania do wysyłki wynosi zazwyczaj od 3 do 21 Dni Roboczych, natomiast w przypadku Produktów cyfrowych (Biblioteka Kadrów), ze względu na proces indywidualnej personalizacji, udostępnienie pliku w formie elektronicznej następuje zazwyczaj w ciągu 24–48 godzin od zaksięgowania wpłaty.

For physical Products (including prints, frames, canvases), the preparation time for shipment is usually 3 to 21 Business Days, whereas for digital Products (Frame Library), due to the individual personalization process, the electronic file is usually made available within 24–48 hours of payment confirmation.

Zamówienia niestandardowe i inwestycyjne:

W przypadku zamówień o charakterze inwestycyjnym (np. wyposażenie biur, hoteli) lub zamówień jednostkowych o znacznej objętości, proces realizacji poprzedzony jest weryfikacją dostępności komponentów.

For investment-related orders (e.g., office or hotel furnishings) or large-scale individual orders, the fulfillment process is preceded by a component availability verification.

b.

Sprzedawca skontaktuje się z Klientem w ciągu 5 Dni Roboczych od złożenia zapytania lub zamówienia w celu potwierdzenia dostępności materiałów gwarantujących spójność kuratorską całego zamówienia oraz przedstawienia wiążącego harmonogramu prac.

b.

The Sales Representative will contact the Customer within 5 Working Days of receiving the inquiry or order to confirm the availability of materials ensuring the curatorial consistency of the entire order and to present a binding work schedule.

Zarządzanie dostępnością i rotacja asortymentu:

Sprzedawca zastrzega sobie prawo do bieżącej aktualizacji oferty, w tym wycofywania poszczególnych konfiguracji Produktów i zastępowania ich nowymi kompozycjami, bez wpływu na zamówienia przyjęte już do realizacji. Sprzedawca zastrzega sobie również prawo do wprowadzania do sprzedaży Produktów w edycjach limitowanych, których dostępność jest ograniczona ilościowo lub czasowo.

The Seller reserves the right to update the offer on an ongoing basis, including withdrawing specific Product configurations and replacing them with new compositions, without affecting orders already accepted for processing. The Seller also reserves the right to introduce Products in limited editions, the availability of which is limited by quantity or time.

b.

W przypadku oferowania końcówek serii, Sprzedawca może wprowadzić w Serwisie ograniczenie liczby dostępnych egzemplarzy. Po wyczerpaniu stanu magazynowego danej konfiguracji, zamówienie jej staje się niemożliwe lub wymaga indywidualnej weryfikacji dostępności.

b.

In the case of offering end-of-series products, the Seller may introduce a limit on the number of available items in the Service. Once the stock of a given configuration is exhausted, ordering it becomes impossible or requires individual verification of availability.

c.

Jeśli po zawarciu Umowy okaże się, że dany komponent stał się trwale niedostępny u dostawców (np. nagłe zaprzestanie produkcji ramy), Sprzedawca niezwłocznie poinformuje o tym Klienta. Z uwagi na kuratorski charakter oferty, Sprzedawca nie dokonuje samowolnej zamiany komponentów na inne niż wybrane przez Klienta. W takim przypadku Klientowi przysługuje prawo do pełnego zwrotu wpłaconych środków lub – po indywidualnej konsultacji – wybór nowej, dostępnej w Serwisie konfiguracji Produktu.

c.

If, after the conclusion of the Agreement, it turns out that a given component has become permanently unavailable from suppliers (e.g., sudden discontinuation of frame production), the Seller shall immediately inform the Customer. Due to the curated nature of the offer, the Seller does not make unauthorized substitutions of components other than those selected by the Customer. In such a case, the Customer is entitled to a full refund of the funds paid or – after individual consultation – the choice of a new Product configuration available on the Service.

c.

Akceptacja wyceny przez Klienta i dokonanie płatności na podstawie przesłanych danych (np. faktury proforma lub dedykowanego linku) jest równoznaczna z zawarciem Umowy o właściwościach określonych w indywidualnych ustaleniach.

c.

The Client's acceptance of the quote and the completion of payment based on the provided details (e.g., a pro forma invoice or a dedicated link) constitutes the conclusion of the Agreement with the specifications defined in the individual arrangements.

7.

Indywidualne modyfikacje i konfiguracje:

Klient ma możliwość zapytania o modyfikację parametrów Produktu (np. niestandardowy format obrazu) za pośrednictwem formularza kontaktowego.

The Client may request modifications to Product parameters (e.g., custom image format) via the contact form.

W przypadku potwierdzenia możliwości technicznej i kuratorskiej wykonania takiej modyfikacji, Sprzedawca przedstawi Klientowi indywidualną wycenę oraz szacowany termin realizacji.

Upon confirming the technical and curatorial feasibility of such a modification, the Seller shall provide the Client with an individual quote and an estimated lead time.

Wszystkie ceny podane w Serwisie są cenami brutto (zawierają podatek VAT) i wyrażone są w złotych polskich (PLN).

All prices provided in the Website are gross prices (inclusive of VAT) and are expressed in Polish Zloty (PLN).

Cena podana przy Produkcie w chwili złożenia zamówienia jest wiążąca dla obu stron.

The price specified for the Product at the time of placing the order is binding for both parties.

Ceny nie zawierają kosztów dostawy, które są wskazywane w procesie składania zamówienia i doliczane do końcowej kwoty do zapłaty.

Prices do not include delivery costs, which are indicated during the ordering process and added to the final amount payable.

Przelew tradycyjny: Realizowany na rachunek bankowy Sprzedawcy wskazany w potwierdzeniu zamówienia lub na fakturze proforma (dostępny głównie dla zamówień indywidualnych i inwestycyjnych).

Traditional bank transfer: Made to the Seller's bank account specified in the order confirmation or proforma invoice (available mainly for individual and investment orders).

Sprzedawca nie realizuje przesyłek za pobraniem.

The Seller does not offer cash on delivery (COD) shipping.

W przypadku zamówień składanych przez system koszykowy Serwisu, płatność następuje w formie 100% przedpłaty. Realizacja zamówienia (produkcja) rozpoczyna się po zaksięgowaniu pełnej wpłaty na rachunku Sprzedawcy.

In the case of orders placed via the Service's cart system, payment is made in the form of a 100% prepayment. Order fulfillment (production) begins after the full payment has been credited to the Seller's account.

Przy zamówieniach inwestycyjnych lub indywidualnych (o których mowa w § 4 ust. 4 i 6), dopuszcza się indywidualne ustalenie harmonogramu płatności, co każdorazowo zostanie potwierdzone w ofercie przesłanej do Klienta.

For investment or individual orders (as referred to in § 4 sec. 4 and 6), an individual payment schedule may be established, which will be confirmed in each instance within the offer sent to the Customer.

Zastrzeżenie własności (zgodnie z Kodeksem cywilnym):

Retention of title (pursuant to the Civil Code):

Zgodnie z art. 589 Kodeksu cywilnego, Sprzedawca zastrzega sobie prawo własności Produktów do momentu uiszczenia przez Klienta pełnej ceny sprzedaży (zapłaty całości kwoty wynikającej z faktury lub umowy).

Pursuant to Article 589 of the Civil Code, the Seller reserves the title to the Products until the Client has paid the full purchase price (payment of the total amount resulting from the invoice or agreement).

b.

Do czasu całkowitego uregulowania należności, Klient występuje wyłącznie w roli posiadacza zależnego Produktu i jest zobowiązany do dbałości o jego stan w sposób nienaruszony.

Until the amounts due are settled in full, the Client acts solely as a dependent possessor of the Product and is obliged to maintain the Product in an intact condition.

c.

Bez wyraźnej, pisemnej zgody Sprzedawcy, Klientowi zabrania się dalszej odsprzedaży, darowizny, obciążania prawami osób trzecich (np. zastawem) lub włączania Produktów objętych zastrzeżeniem własności do masy majątkowej podlegającej egzekucji komorniczej lub upadłościowej.

c.

Without the express written consent of the Seller, the Client is prohibited from further resale, donation, encumbering with third-party rights (e.g., a pledge), or including Products subject to retention of title in the assets subject to judicial execution or bankruptcy estate.

Dokumentowanie sprzedaży:

Do każdego zamówienia Sprzedawca wystawia fakturę VAT.

The Seller issues a VAT invoice for each order.

Klient wyraża zgodę na otrzymywanie faktur drogą elektroniczną na adres e‑mail podany w zamówieniu.

The Customer agrees to receive invoices electronically at the e‑mail address provided in the order.

Sprzedawca korzysta ze zwolnienia z obowiązku ewidencjonowania sprzedaży przy zastosowaniu kas rejestrujących (kasy fiskalnej), zgodnie z obowiązującymi przepisami prawa, pod warunkiem otrzymania płatności w całości za pośrednictwem banku lub poczty.

c.

The Seller benefits from an exemption from the obligation to record sales using cash registers (fiscal registers), in accordance with applicable legal regulations, provided that the payment is received in full via a bank or postal service.

W przypadku braku odnotowania płatności w terminie 3 Dni Roboczych od dnia złożenia zamówienia (przy wyborze płatności elektronicznych lub przelewu), zamówienie zostaje anulowane, o czym Klient zostanie poinformowany drogą mailową.

In the event that payment is not recorded within 3 Business Days from the date the order is placed (for electronic payments or bank transfers), the order shall be cancelled, and the Customer will be notified thereof via email.

Przesyłka do wybranego przez Klienta Paczkomatu InPost.

Delivery to an InPost Parcel Locker selected by the Client.

Przesyłka kurierska InPost (pod wskazany adres).

Dostawa dedykowana lub paletowa – w przypadku zamówień wielkogabarytowych lub inwestycyjnych, po indywidualnym uzgodnieniu kosztów i terminu.

Dedicated or pallet delivery – for oversized or investment orders, subject to individual cost and schedule arrangements.

Standardowy czas doręczenia przez firmę kurierską wynosi zazwyczaj od 1 do 3 Dni Roboczych od momentu nadania przesyłki przez Sprzedawcę.

Standard delivery time by the courier company is usually 1 to 3 Business Days from the moment the Seller dispatches the shipment.

c.

Sprzedawca wskazuje, że czas doręczenia deklarowany przez przewoźnika ma charakter orientacyjny i jest on niezależny od czasu realizacji zamówienia przez Sprzedawcę.

c.

The Seller indicates that the delivery time declared by the carrier is approximate and independent of the Seller's order processing time.

Niepodjęcie przesyłki i koszty zwrotu:

W przypadku nieodebrania przesyłki przez Klienta i jej powrotu do Sprzedawcy, Sprzedawca skontaktuje się z Klientem w celu wyjaśnienia sytuacji.

If the Client requests re-shipment, the Client is obliged to cover the costs of re-dispatching the shipment and the costs of its return to the Seller, according to the operator's current price list. Re-shipment will take place after the payment for these costs has been credited to the Seller's account.

Przerwy techniczne i urlopowe: Sprzedawca zastrzega sobie prawo do okresowego wydłużenia czasu realizacji zamówień z przyczyn operacyjnych (np. przerwy urlopowe, święta, wyjazdy fotograficzne).

Color Disclaimer: The Seller makes every effort to ensure that the photographs presented on the Website reflect the actual colors of the Products as accurately as possible. The Seller uses professional, calibrated graphics monitors during the file preparation process. Nevertheless, due to image display technology (the monitor's RGB color space) and printing technology (the medium's CMYK color space), as well as differences in color rendering resulting from the Customer's hardware settings (brightness, contrast, color temperature), slight variations in color shades do not constitute grounds for a Product complaint regarding non-conformity with the agreement.

The Seller may propose to the Customer the dispatch of a replacement part (e.g., a frame, acrylic glass) for self-assembly. Use of this option is voluntary and requires the Customer's consent. In the event that consent is granted, the Customer shall be liable for any damage to the Product resulting from unprofessional assembly/replacement or assembly/replacement carried out contrary to the instructions.

Samodzielna wymiana elementu za zgodą Klienta nie stanowi podstawy do roszczeń o dodatkowe obniżenie ceny Produktu, o ile przywraca ona Produktowi pełną zgodność z umową.

Self-replacement of a component with the Customer's consent shall not constitute grounds for claims for an additional reduction in the Price of the Product, provided that such replacement restores the Product to full conformity with the contract.

Jeśli naprawa lub wymiana są niemożliwe, Sprzedawca może zaproponować obniżenie ceny. Klient może odstąpić od umowy (żądać zwrotu całości wpłaty) wyłącznie w przypadku, gdy wada ma charakter istotny. Za wadę istotną nie uznaje się uszkodzeń elementów wymiennych Produktu (np. ramy, szkła, wydruku, passe-partout), które Sprzedawca zaoferował wymienić na wolne od wad.

If repair or replacement is impossible, the Seller may propose a price reduction. The Customer may withdraw from the contract (demand a full refund) only if the defect is material. Damage to replaceable components of the Product (e.g., frame, glass, print, passe-partout) that the Seller has offered to replace with defect-free ones shall not be considered a material defect.

W przypadku konieczności odesłania Produktu, odbywa się to w sposób i za pośrednictwem przewoźnika wskazanego przez Sprzedawcę (np. poprzez udostępnienie Klientowi etykiety zwrotnej). Sprzedawca nie przyjmuje przesyłek odsyłanych za pobraniem lub bez wcześniejszego uzgodnienia. Klient jest zobowiązany do starannego zabezpieczenia odsyłanego Produktu, najlepiej w oryginalnym opakowaniu, aby zapobiec uszkodzeniom w transporcie.

In the event that the Product needs to be returned, it shall be done in a manner and via a carrier designated by the Seller (e.g., by providing the Customer with a return label). The Seller does not accept COD (Cash on Delivery) shipments or those sent without prior consultation. The Customer is obliged to carefully secure the returned Product, preferably in its original packaging, to prevent damage during transport.

damage resulting from exposing the Product to extreme humidity, high temperatures, or direct, long-term aggressive sunlight (unless the product specification states otherwise),

c.

samodzielnych prób naprawy lub modyfikacji Produktu przez Klienta.

By purchasing a physical Product, the Customer becomes the owner only of its physical copy. Rozwiązanie to nadaje Produktowi charakter unikalny, a jednocześnie służy ochronie przed nieautoryzowanym rozpowszechnianiem kopii w sieci, na co Klient wyraża zgodę.

This solution gives the Product a unique character while simultaneously serving as protection against unauthorized distribution of copies online, to which the Customer agrees.

Niedozwolone jest utrwalanie i zwielokrotnianie Utworów jakąkolwiek techniką – w tym drukarską, reprograficzną, zapisu magnetycznego oraz techniką cyfrową – w celu ich dalszego udostępniania, odsprzedaży lub wykorzystania komercyjnego bez wyraźnej, pisemnej zgody Sprzedawcy.

Prohibition of Reproduction and Distribution: It is strictly forbidden to copy, scan, digitize, or modify the content of albums and e‑books. It is prohibited to record or reproduce the Works by any technique – including printing, reprography, magnetic recording, and digital techniques – for the purpose of further sharing, resale, or commercial use without the express, written consent of the Seller.

Prawa Osobiste i Integralność: Twórcy przysługuje niezbywalne prawo do autorstwa oraz zachowania integralności Dzieła. Klient zobowiązuje się do nieingerowania w formę i treść Utworów (np. poprzez usuwanie oznaczeń autora, zmianę kolorystyki czy kadrowanie). Wykorzystanie Utworów jako elementu projektów komercyjnych (np. wystrój wnętrz komercyjnych w celach reklamowych) wymaga odrębnej zgody lub licencji.

Moral Rights and Integrity: The creator holds the inalienable right to authorship and to maintain the integrity of the Work. The Client undertakes not to interfere with the form or content of the Works (e.g., by removing author markings, changing colors, or cropping). The use of the Works as an element of commercial projects (e.g., commercial interior design for advertising purposes) requires separate consent or a license.

Gwarancja legalności i Property Release: Sprzedawca oświadcza, że posiada wszelkie niezbędne uprawnienia do komercyjnego wykorzystania wizerunków obiektów, miejsc lub osób utrwalonych na Dziełach, o ile ich wykorzystanie w świetle obowiązujących przepisów wymagało uzyskania zgody osób trzecich lub właścicieli obiektów (tzw. zgoda na wykorzystanie wizerunku mienia). Klient nabywając Produkt, otrzymuje gwarancję, że jego eksploatacja w zakresie określonym Regulaminem nie narusza praw osób trzecich i nie będzie skutkować roszczeniami z ich strony wobec Klienta.

Guarantee of Legality and Property Release: The Seller declares that they hold all necessary rights for the commercial use of images of objects, places, or persons captured in the Works, provided that their use under applicable law required the consent of third parties or owners of the objects (so-called property release). By purchasing the Product, the Client receives a guarantee that its exploitation within the scope defined by the Regulations does not infringe upon the rights of third parties and will not result in any claims by them against the Client.

Sprzedawca zastrzega sobie prawo do ochrony swoich praw autorskich poprzez monitoring rynku oraz dochodzenie roszczeń o odszkodowanie i zaniechanie naruszeń w przypadku wykrycia nieuprawnionego wykorzystania Utworów.
